The AHA and other plaintiffs have filed a lawsuit challenging the program, and Congressman Tracey Mann and bipartisan colleagues introduced legislation to delay its implementation.

Representative Sharice Davids recently introduced a series of bills addressing rural hospital sustainability, maternity care, anesthesia services and health care affordability.

(Aug. 31, 2026) - KHA submitted comments on the CY 2027 OPPS Proposed Rule, raising concerns about the proposed payment update, 340B reductions, site-neutral policies and other proposals affecting hospital access and operations. Comments are due today, Aug. 31, and hospitals are encouraged to use KHA’s comments as a resource for their own submissions.

(Aug. 5, 2026) - A bipartisan group of six U.S. senators, including Sen. Jerry Moran, introduced the SUSTAIN 340B Act, comprehensive legislation that would preserve point-of-sale discounts, establish a national clearinghouse, protect contract pharmacy arrangements and address many of the legal and administrative challenges facing the 340B program.
