The Senate Takes Final Action and Debates Bills

Kansas Senate Chamber (March 28, 2023) – Today, the Senate chamber took final action on the following bills debated yesterday:

Senate Bill 252 provides for exemptions from property tax and sales tax for certain businesses competing against governmental entities. Passed on a vote of 24-16.

Senate Bill 265 increases the criminal penalties for repeat violations of a protective order. Passed on a vote of 40-0.

Senate Bill 309 creates the fixing instant revenue shock for the Taxpayers' Fund and Local Extraordinary Needs Fund; establishes the Joint Committee on Local Extraordinary Needs grants and abolishes the Local Ad Valorem Tax Reduction Fund. Failed on a vote of 17-23.

House Bill 2082 authorizes counties to create a Code Inspection and Enforcement Fund and Municipalities Fight Addiction Fund; expands the scope of the County Equipment Reserve Fund to include other technology expenses. Passed on a vote of 38-2.

House Bill 2125 assures that hospitals and long-term care facilities do not have to have licensed salons; provides for charitable event permits and demonstration permits for body art services; authorizes cease and desist orders against unlicensed providers of body art services; requires related administrative actions to be in accordance with the Kansas Administrative Procedure Act and reviewable under the Kansas Judicial Review Act. Passed on a vote of 38-1.

House Bill 2263 authorizing pharmacy technicians to administer certain vaccines; creates a civil cause of action against a physician; requires revocation of a physician's license who performs a childhood gender reassignment service. Passed on a vote of 26-10.

House Bill 2269 amends the Kansas Cigarette and Tobacco Products Act to raise the minimum age to 21 years old for the sale, purchase or possession of cigarettes, electronic cigarettes or tobacco products. Passed on a vote of 28-11.

House Bill 2288 enacts the Counseling Compact to provide for interstate practice privileges for professional counselors. Passed on a vote of 36-4.

House Bill 2292 enacts the Kansas Apprenticeship Tax Credit Act to encourage the development of apprenticeship programs in Kansas by providing income tax credits for participating businesses that employ apprentices. Passed on a vote of 30-7.

House Bill 2375: establishes temporary candidacy baccalaureate and masters social work licenses; provides requirements and fees therefor. Passed on a vote of 39-1.

The following bills were debated on the floor and will receive final action votes either late today or possibly tomorrow.

Senate Substitute for House Bill 2390 requires the secretary of the Kansas Department of Health and Environment to study drug overdose death cases; provides for the confidentiality of acquired and related records; restricts the authority of the secretary of the Kansas Department of Health and Environment and local health officers to prevent the introduction and spread of infectious or contagious diseases; repeals the authority of the secretary to quarantine individuals and impose associated penalties. The body saw a procedural motion to not adopt the committee report, which would have taken the bill back to the version as passed by the House. The motion failed on a vote of 21-13. The bill was moved toward a final vote by the body on a vote of 22-18.

Senate Bill 287 expands the Kansas Silver Alert Plan to include persons 18 years of age or older who have dementia, a developmental disability or cognitive impairment.

Senate Bill 297 revises the definition of "abortion" to clarify procedures excluded from such definition.

Senate Bill 314 prohibits the secretary of the Kansas Department of Health and Environment from requiring COVID-19 vaccination for children attending a childcare facility or school.

House Bill 2326 extends the sunset date on the Scrap Metal Theft Reduction Act and clarifies that catalytic converters are covered by the Act.

House Bill 2325 adds "maternity center" to the definition of "healthcare provider" for purposes of the Healthcare Provider Insurance Availability Act.

Senate Bill 307 adds "for-profit private entity" to the definition of "qualified applicant" in the Kansas Fights Addiction Act.

House Bill 2313 creates the Born-Alive Infants Protection Act to provide legal protections for infants who are born alive regardless of the intent of the delivery.

Senate Bill 315 requires childcare facilities, elementary, secondary and postsecondary educational institutions and employers to grant exemptions from vaccine requirements without inquiring into the sincerity of the request; repeals the meningitis vaccine requirement to live in student housing.

Senate Substitute for House Bill 2170 creates the Donor Intent Protection Act to provide enforcement of donor-imposed restrictions on philanthropic gifts of endowment funds or to endowment funds.
