(June 30, 2026) - The House Committee on Ways and Means has announced it will mark up H.R. 9504, the Tax-Exempt Hospital Transparency Act, tomorrow, July 1, which would add reporting requirements for hospitals’ Schedule H IRS forms.
This effort was initially proposed to the committee for consideration in May but was later withdrawn. Our team is continuing to review the bill language, but it appears that the bill would require tax-exempt hospitals to report annually on:
- How the organization is addressing the needs identified in the most recent community health needs assessment;
- The audited financial statements of the organization;
- Centers for Medicare & Medicaid Services certification number;
- The value of the organization’s financial assistance policy provided to patients; and
- Other data related to the utilization of the organization’s financial assistance policy.
Certain hospitals would also be required to submit a swath of additional information on a variety of topics, including information that is already available through existing reporting mechanisms.
