CMS Solicits Feedback on Domestic Supply Chains

Nurse Putting on Protective Gear (Jan. 29, 2026) - On Jan. 26, 2026, CMS released an advance notice of proposed rulemaking on “Ensuring Safety through Domestic Security with Made in America Personal Protective Equipment and Essential Medicine Procurement Participating Hospitals.”

The notice seeks public comment on a possible new “Secure American Medical Supplies” designation for Medicare participating hospitals that demonstrate a commitment to procuring domestic PPE and essential medicines.

Specifically, CMS requests feedback on:

  • “streamlined payment policies” for hospitals with such a designation. 
  • a structural measure within the Hospital Inpatient Quality Reporting program “requiring hospitals to attest to meeting domestic procurement designation minimum percentages for PPE and essential medicines;” 
  • other policies within CMS’s authorities “to help foster a more resilient supply chain for domestically manufactured PPE and essential medicines.” 

The Kansas Hospital Association will be developing comments to CMS on this request for information, and encourages members to provide their feedback to Jaron Caffrey by Feb. 20, 2026.
