340B Continues to Receive Attention in Washington

340B2 (June 30, 2026) - There have been several federal 340B Drug Pricing Program-related activities over the past month, and we want to ensure members have the latest information.

The Kansas Hospital Association will respond to the Health Resources and Services Administration's information collection request regarding a revised 340B rebate model pilot program by the July 15 deadline. The pilot program would enable qualifying drug manufacturers to effectuate the 340B ceiling price to a limited set of drugs sold to covered entities using rebates. We greatly appreciate the strong member feedback shared thus far. If you have additional comments on the burden the pilot would place on impacted stakeholders, we encourage you to share them with our team within the next week. KHA 340B members received an email from Karen Braman with additional details on June 15th, and you are encouraged to submit individual comments on this ICR by the July 15 deadline. Additionally, two pieces of 340B legislation are under discussion in both chambers of Congress, underscoring the need for robust protections for the program. U.S. Senator Bill Cassidy (R-LA) recently introduced a legislative discussion draft that would make several changes to the 340B Drug Pricing Program. Sen. Cassidy has requested comments on the draft legislation by Aug. 28. Cassidy’s webpage has more information on the discussion draft, including a one-pager and a section-by-section summary.

The House of Representatives has also had a group of lawmakers exploring 340B legislation through the SECURE 340B Act. This proposal under discussion would also make sweeping reforms to many aspects of the program. We will continue to review both bills and plan to provide comments on the draft legislation. The Senate’s bipartisan Group of Six continues to work toward introducing its own 340B reform bill, which may be introduced soon.
