Trump Administration Signs Executive Order Reclassifying Marijuana. but It Remains Illegal
(Dec. 24, 2025) – Last week, the Trump Administration signed an executive order reclassifying marijuana from a Schedule I controlled substance (C-I) to a Schedule III controlled substance (C-III). However, the order does not legalize marijuana under federal law, and the proposed change still requires federal regulatory approval. According to the Drug Enforcement Administration, Schedule I drugs have no currently accepted medical use and a high potential for abuse. Schedule III drugs are defined as having a moderate to low potential for physical and psychological dependence, with a drug abuse potential less than Schedule I and Schedule II drugs, but more than Schedule IV drugs. Following the Trump Administration's announcement, the Kansas Bureau of Investigation issued a statement reiterating that cultivating, distributing and possessing marijuana-derived THC products remain illegal in Kansas under federal law. The KBI will continue to enforce existing laws.
