Federal Judge Vacates H1-B Visa Fees
A federal judge struck down the Donald Trump administration's $100,000 fee on H1-B visa applications for skilled foreign workers, ruling it an unlawful tax rather than a monetary penalty authorized by federal immigration law. Because the president lacks the power to impose taxes, the court vacated the fee as unlawful.
The lawsuit was brought by 20 state attorneys general. Other challenges to the policy are pending, and the federal government has announced its intent to appeal the ruling.
