(Dec. 5, 2025) – This week, the American Hospital Association announced that AHA, the Maine Hospital Association and four safety-net health systems nationwide filed a lawsuit in the United States District Court for the District of Maine on Dec. 1 to stop the 340B Rebate Model. The 340B rebate model pilot, announced by the federal Health Resources and Services Administration in the Aug. 7 Federal Register, is scheduled to begin Jan. 1, 2026, with ten drugs for which the pharmaceutical manufacturer received approval for its rebate application.
The Kansas Hospital Association submitted comments opposing the rebate model in August and continues to advocate for protection of the 340B program. AHA's lawsuit emphasizes the financial burden the rebate model would place on hospitals and other safety-net providers that are already facing significant financial stress.
