PBM Reform Amended and Recommended by Senate Financial Institutions

(Feb. 5, 2026) – Today, the Senate Financial Institutions and Insurance Committee took up the Pharmacy Benefit Managers' Reform Bill, Senate Bill 360, which enacts the Consumer Prescription Protection and Accountability Act and provides for the regulation and registration of pharmacy benefit managers. The committee considered an amendment to remove self-funded employee plans from the bill, which passed. The committee then considered an amendment from Senator Beverly Gossage (R-Eudora) to eliminate the minimum dispensing fee from the bill. The amendment was not adopted. The committee next considered an amendment from Senator Kellie Warren (R-Olathe) to address personal health information. The committee recommended the bill favorably for passage as amended by a 6-3 vote.

Next, the committee held a hearing on Senate Bill 55, which prohibits the assignment of benefits under certain property and casualty insurance contracts and defines such assignment of benefits as an unfair method of competition and an unfair or deceptive act or practice. When asked when this tactic may be appropriate, Mr. Roberts pointed to the medical industry but noted it is dealing with bad actors.
