Due to recent media stories in Kansas City, the law concerning the performance of blood alcohol and drug tests has been called into question. Since this is an issue of statewide application, we wanted to provide you with a legal analysis regarding this topic, including an outline that provides a detailed explanation of the relevant portions of K.S.A. 8-1001 regarding testing blood for alcohol or drugs. We also have included decision trees to assist your facility when responding to a law enforcement officer's request for a blood draw.
